1. About these terms
These terms describe the conditions for using Hushed Chat, including its website, AI character conversations and interactive stories. If you do not accept these terms, do not use the service. By creating an account or purchasing a subscription, you agree to these terms.
The service is operated by Hushed Chat, with its registered address in China. References to “we”, “us” or “our” mean Hushed Chat.
2. Age and account security
Hushed is available to users outside mainland China who are at least 18 years old and can enter into an agreement under the laws that apply to them. The service is not offered to users in mainland China. You must not misrepresent your age or location to bypass this restriction. Access remains subject to applicable law. Provide accurate registration information, keep your credentials private and use only accounts you are authorized to access.
You are responsible for your use of the service. If you suspect unauthorized access, secure your sign-in account and report the issue to [email protected].
3. AI conversations and availability
Hushed offers online, digital experiences with fictional AI characters. Characters are not real people, and responses can be inaccurate, inconsistent or inappropriate. Conversations are for entertainment; they are not medical, legal, financial or emergency services.
Features may depend on account eligibility, your plan and the availability of third-party infrastructure. Paid access is available after payment and membership activation are confirmed. A payment redirect alone does not confirm activation.
4. Plans, payments and renewal
Available plans are shown on our pricing page. Review the price, currency, taxes, billing interval and included features in checkout before authorizing payment. Only plans currently offered for purchase can be ordered.
A recurring subscription authorizes the charges and renewal interval disclosed in checkout until cancellation. Payments use the hosted checkout provider selected on the plans page, currently Stripe or Waffo Pancake. Hushed receives transaction and membership information; payment card details are entered with the payment provider.
Changes affecting an existing subscription will be communicated before they apply, with any notice or cancellation rights required by applicable law.
5. Canceling a subscription
Sign in, open Membership & plans, use the subscription management action shown for your payment provider, and review the cancellation confirmation and access end date.
You may also request cancellation by emailing [email protected] from your registered email. Cancel before the next renewal to prevent the next charge. Unless you request immediate termination or receive a refund that ends access, your membership remains available through the paid billing period. Cancellation stops future renewals.
Closing checkout, signing out, clearing browser data or deleting a local conversation does not cancel a subscription. Subscription cancellation and account deletion are separate requests.
6. Refunds and billing issues
Your mandatory consumer rights remain applicable to digital purchases. If you believe a charge is duplicated, unauthorized or incorrect, retain the receipt and transaction reference so the charge can be investigated. Never send a full card number or security code in a support request.
- First subscription: request a full refund within 7 calendar days of your first subscription payment. This guarantee applies once per customer, regardless of usage during that period.
- Renewals and later requests: renewal charges and requests made after the initial 7-day window are generally non-refundable. Canceling partway through a billing period does not create a prorated refund entitlement.
- Exceptions: verified duplicate charges and billing errors will be corrected or refunded. If we permanently discontinue a paid service for reasons unrelated to your breach, we will refund the unused prepaid portion.
- Statutory rights: mandatory withdrawal, refund and other consumer rights in your jurisdiction take priority over these rules.
Email [email protected] from your account email with your transaction reference and reason. We aim to respond within 2 business days and issue an approved refund to the original payment method within 5 business days. Your bank or payment provider may take additional time to post it. A full subscription refund ends the access covered by that payment and its associated renewal.
7. Acceptable use
Use Hushed lawfully and respect other people and their rights. You must not:
- Create or distribute sexual content involving minors, exploitative material or non-consensual intimate content.
- Threaten, harass, defraud or impersonate others, or disclose someone else’s private information without authorization.
- Upload content that infringes intellectual property rights or use generated content to mislead people about a real person’s identity or actions.
- Deploy malware, evade access restrictions, interfere with security or overload the service through automated extraction or other abusive activity.
- Sell access to another person’s account or present AI conversations as advice from a qualified professional.
8. Your content and intellectual property
You retain any rights you already hold in content you submit. You must have the rights needed to upload it. You permit Hushed to process that content as necessary to deliver the features you choose, such as generating a reply or displaying a character you publish.
Publishing a character or other material makes it available to other users according to the visibility you select. Do not publish private information you intend to keep confidential.
AI responses may resemble other outputs and may not qualify for exclusive legal protection. Review output before sharing or using it. Hushed’s branding, interface and software remain protected by their respective owners’ rights.
9. Privacy and stored data
Our Privacy Policy explains account information, chat processing, browser storage and service providers. Do not submit sensitive information that is unnecessary for your conversation.
Some drafts and preferences exist only on your device. Export anything you want to keep before clearing local data. Clearing that data does not erase information held in your online account.
10. Service restrictions and termination
Access may be restricted when necessary to respond to abuse, security threats, nonpayment or legal requirements. Where appropriate, the reason and available resolution steps will be communicated to you.
You may stop using the service at any time. Use the billing portal to manage recurring charges. Any account deletion request must be handled separately by emailing [email protected]; rights relating to prepaid access or refunds remain subject to applicable law.
11. Disclaimers and your legal rights
We cannot guarantee uninterrupted service, preservation of device-only drafts or the accuracy of AI responses. Assess responses before acting on them and maintain your own copies of important content.
Nothing in these terms excludes a warranty, remedy or liability that cannot lawfully be excluded. Any limitations must be interpreted consistently with mandatory consumer protections.
12. Changes, disputes and contact
Material changes will be identified on this page and communicated through appropriate service notices. The updated date identifies the version you are reading. Where required, renewed agreement will be requested before new terms apply.
These terms are governed by the laws of the People’s Republic of China, without excluding mandatory protections that apply in your place of residence. Contact us first to try to resolve a dispute. Nothing here prevents you from bringing a claim before a court that has jurisdiction under applicable law.
